Meggs Dear Jon: I am enclosing a copy of the Notice of Appeal that we have filed in the above case pursuant to instructions from Jodi Chase. This will also confirm our understanding that the League will deposit the sum of $2,500 with our firm to be applied toward court costs and other expenses related to the appeal. We will proceed with the appeal on a contingency basis, with the understanding that our fee for such appeal will be dependent upon an award by the Court to be paid by the opposing party in the event that we are successful. Jodi told me that some of the members felt that I had not kept them fully apprised of developments in the case. I hope that you will assure the membership that I have given the League notice immediately upon the occurrence of any event in the case. The problem was that the Court took no action after the filing of briefs by the parties in May, 1994, and there was nothing further that we could do to move the case along. When the United States Supreme Court decided a new case last month which had a bearing upon the decision, I used that decision as an opportunity to bring the case back to the Court's attention by filing a notice of additional authority and requesting oral argument. I advised the League immediately upon such filing by letter and copies of the notice and motion. I regret that the case has taken this long, but sometimes the wheels of justice grind very slowly and there is little that the lawyers can do to increase their speed. I will continue to keep you fully informed as the appeal progresses.
