Lorillard Co., Philip Morris, Inc., Ligget & Myers Tobacco Co., and Brown & Williamson Co., the six major cigarette manufacturers in the United States, are devoting millions of dollars annually in research and in advertising, much of which they concede is necessitated to overcome the unfavorable propaganda created in reports by various cancer societies and in United States Government reports, notably the most recent one titled "Smoking and Health - Report of the Advisory Committee to the Surgeon General of the Public Health Service", with no conclusive results, and WHEREAS, in their endeavors to combat the unfavorable and damaging propaganda the said six major cigarette companies have been forced into vast expenditures annually which may a be summarized as follows: (latest figures - Business Week) Advertising - TV billings, newspapers and magazines..$146,600,000. " -Radio networks, etc.,..estimated at.....$8,000,000. Grants to their joint "Council for Tobacco Research".. 7,250,000. Grants to the American Medical Association............10,000,000. Sum of the above $201,850,000 WHEREAS, through observations, research and study, F. N. Jean Gindorff, of 57 Lexington Avenue, New York, N.Y. may have a come upon the answer to the long and costly quest - the cause, not the symptoms of lung cancer in humans or animals; and WHEREAS, if the said F. N. Jean Gindorff's observations, research and study shall be proved correct and established as sound by strictly independent sources, it would appear that release of his findings would result in tremendous annual savings to each and all of the said six major cigarette companies; and WHEREAS, the said F. N. Jean Gindorff, with the aid of a chemical engineer, has examined at length, among other documents, the following: "Survey of (982) Compounds Which Have Been Tested For Carcinogenic Activity" - Federal Security Agency - U. S. Department of Health, Education and Welfare - Public Health Service (U.S. Government Printing Office - P.H.S. Publication No. 149). "Smoking and Health - Report of the Advisory Committee to the Surgeon General of the Public Health Service", 1964 (undated). Annual Reports of the Scientific Director of the Council For Tobacco Research - U. S. A. (formerly The Tobacco Industry Research Committee). Numerous publications by foreign and American groups, including annual reports of the various cancer societies; and WHEREAS, the results of all his researchings of the above and other published material on the subject of possible incidence of lung cancer from tobacco smoking lead the said Gindorff to the conviction that what he describes at present as secret Agent X has not been identified or discussed in any of the vast literature he has read and analysed. NOW, THEREFORE, if any or all of the said six major cigarette companies utilise for their individual or joint benefit, in their private or public advertising or propaganda, or in any manner whatsoever, directly or indirectly, the said F. N. Jean Gindorff's idea or discovery of the said Agent X, the said six companies hereby jointly and severally agree to pay him as compensation for such utilisation one-half (1/2) of One PerCent of the annual $200,000,000. now being exposted by these companies in advertising.
